Disputed Wills
If you believe that you have not been adequately provided for or left out of a will, than you may be eligible to make a claim under Section 91 of the Administration & Probate Act 1958. Unlike other states in Australia, which specifically defined the various classes of persons who could institute proceedings, the position in Victoria is now very broad. The court may order that provision be made out of the estate of the deceased for the proper maintenance and support of a person for whom the deceased had responsibility to make provision. This means that an unlimited class of persons may apply.
